Terms and conditions

1. Purpose

These terms and conditions govern the use of the Stimhaus AI service (stimhaus.ai): automated generation of premium websites for small businesses using artificial intelligence, and Swiss hosting of the delivered site.

2. Launch phase — Free

During the launch phase, the Stimhaus AI service is offered free of charge, with no credit card and no commitment. Customers who sign up during this phase retain lifetime free access to the current offering. Additional premium features added later may be billed.

3. Account creation

Use of the service requires the creation of an account via a conversation with Emma. The information provided must be accurate and up to date. You are responsible for keeping your credentials confidential.

4. Stimhaus obligations

• Generate a premium site tailored to your business within a reasonable timeframe (typically 2-10 minutes)
• Host the site on our Infomaniak servers (Geneva, Switzerland) for the duration of the subscription
• Ensure reasonable service availability (best effort, no guaranteed SLA during the free phase)
• Protect your data in accordance with our privacy policy

5. User obligations

• Provide accurate information about your business
• Not use the service for illegal, hateful, discriminatory or fraudulent content
• Not attempt to circumvent security mechanisms
• Respect intellectual property rights (do not upload content you do not have rights to)

6. Ownership of the generated site

The website generated by AI and the content you provided (text, photos, logos) remain your property. You can export your site's source code at any time and host it elsewhere. Base templates and graphic components remain the property of Stimhaus but their use in your site is granted under license.

7. Suspension and termination

You can cancel your account at any time, for any reason. Stimhaus reserves the right to suspend or terminate an account in the event of a violation of these terms (particularly illegal content, fraud, abuse). Termination triggers the deletion of your data within 30 days (subject to legal obligations).

8. Liability

The service is provided "as is". Stimhaus does everything possible to ensure quality of service but cannot guarantee the total absence of errors, interruptions or bugs. Stimhaus cannot be held liable for indirect damages (loss of customers, lost profits, etc.) related to use of the service. Stimhaus's liability, should it be engaged, is limited to amounts actually received for the subscription (zero during the free phase).

9. Changes

Stimhaus may modify these terms. Material changes are notified by email at least 30 days before they take effect. Continued use of the service after that period constitutes acceptance.

10. Governing law and disputes

These terms are governed by Swiss law. Any dispute relating to the execution of these terms falls under the exclusive jurisdiction of the courts of Geneva (Switzerland), except for mandatory provisions in favor of consumers.
