Terms and conditions

1. Purpose

These terms and conditions govern the use of the Stimhaus AI service (stimhaus.ai): automated generation of premium websites for small businesses using artificial intelligence, and Swiss hosting of the delivered site, as well as the Emma assistant (WhatsApp and chat on the business's website).

2. Plans and pricing

The Stimhaus AI service is offered in particular in 2 plans: Light, free for 90 days (then 19 USD/month), and Pro at 49 USD/month (first month free if eligible). Other plans may be offered on request. The Light plan is free for 90 days from sign-up, with no credit card and no commitment. After that period it costs 19 USD/month: we inform you by email at least 30 days before the end of your free period, and you remain free to cancel at no cost. Businesses that signed up before 30 October 2026 keep the offer in force when they signed up: the Light plan stays free for 12 months (until 17 October 2027 for those who signed up before 17 October 2026, 12 months after sign-up for the others), with 60 days' notice. The Pro plan includes a first month free if eligible, no commitment; a credit card is required at subscription (Stripe secure payment) and no charge is made during the first month. The free first month applies only once per business. Cancellation possible anytime from your dashboard.

Each plan is used within the limits shown on the Pricing page (for example Light: 1 site, 100 customer messages and 100 owner messages per month; Pro: up to 5 sites).

Unlimited messages on the Pro plan are understood for the normal use of a business; abnormal or automated use may be limited.

Launch offers may change: any change in the price or content of a current plan is announced by email at least 30 days in advance, and you may then cancel free of charge. This period does not shorten the notice given before the end of your free period (30 days, or 60 days for the 12-month offer).

3. Account creation

Use of the service requires the creation of an account via a conversation with Emma. The information provided must be accurate and up to date. You are responsible for keeping your credentials confidential.

4. Stimhaus obligations

• Generate a premium site tailored to your business within a reasonable timeframe (typically 2-10 minutes)
• Host the site on our Infomaniak servers (Geneva, Switzerland) for the duration of the subscription
• Ensure reasonable service availability (best effort, no contractually guaranteed SLA)
• Protect your data in accordance with our privacy policy

5. User obligations

• Provide accurate information about your business
• Not use the service for illegal, hateful, discriminatory or fraudulent content
• Not attempt to circumvent security mechanisms
• Respect intellectual property rights (do not upload content you do not have rights to)

6. Content and intellectual property

The content you provided (text, photos, logos) remains your property. The platform's templates, graphic components and technical elements remain the property of Stimhaus; their use is licensed as part of the service, for the duration of the subscription.

7. Suspension and termination

You can cancel your account at any time, for any reason. Stimhaus reserves the right to suspend or terminate an account in the event of a violation of these terms (particularly illegal content, fraud, abuse). Termination triggers the deletion of your data within 30 days (subject to legal obligations).

8. Liability

The service is provided "as is". Stimhaus does everything possible to ensure quality of service but cannot guarantee the total absence of errors, interruptions or bugs. Stimhaus cannot be held liable for indirect damages (loss of customers, lost profits, etc.) related to use of the service. Stimhaus's liability, should it be engaged, is limited to amounts actually received for the subscription over the 12 months preceding the triggering event. These limitations do not apply in case of intent or gross negligence.

8a. Emma assistant

Emma answers the business's customers from the information validated by the business owner (profile, opening hours, services, prices, catalogue). The business owner remains responsible for the accuracy of this information and for keeping it up to date. Emma's answers are produced by an artificial-intelligence service: they may contain errors and do not replace professional advice. The bubble installed on the business's website is active only once the business owner has validated it; without validation within 7 days it is removed from the website, and a later validation puts it back. Emma may also answer artificial intelligence assistants that query the business on someone's behalf. These exchanges count towards the plan's customer messages; Stimhaus may limit, suspend or withdraw them at any time. Stimhaus's liability for Emma's answers is limited under the conditions of article 8.

9. Changes

Stimhaus may modify these terms. Material changes are notified by email at least 30 days before they take effect. Continued use of the service after that period constitutes acceptance. Minor changes (corrections, clarifications, with no adverse effect for you) apply as soon as they are published on this page.

10. Governing law and disputes

These terms are governed by Swiss law. Any dispute relating to the execution of these terms falls under the exclusive jurisdiction of the courts of Geneva (Switzerland), except for mandatory provisions in favor of consumers.
